Supreme Court Paves Way for Inclusive Medical Education

Landmark ruling allows “MBBS Admissions” for Candidates with “Speech and Language Disabilities.”

In a landmark ruling, the Supreme Court of India has held that candidates with speech and language disorders with more than 40% should not be barred from studying the MBBS course.

This represents a leap in the step towards inclusiveness in medical education by recognising the fact that limitations of a person change the outlook with which disability needs to be approached.

In India, the prevalence of speech and language disabilities is a significant concern. According to the Census of India 2011, about 7% of the population with disabilities report having speech disabilities. Addln, a study on communication disorders in a rural population of India found that 9.42% of individuals at risk of communication disorders had speech and language disabilities.

Background of the Case
The petitioner was a student with a speech and language disability of 40-45% and was refused admission into an MBBS course following the National Medical Commission (NMC) law. These rules have all prohibited the acceptance of candidates with specified forms of disabilities into medical education
regardless of objective measurement of the degree of such disabilities.

The Supreme Court, in its judgment, highlighted several key points:

  1. The Court stated that the mere occurrence of an existing disability should not exclude a candidate from pursuing medical study. Instead, a disability assessment board should conduct a thorough evaluation to determine the candidate’s ability to complete the course.
  2. The Court stressed that in order to guarantee that choices are based on individual evaluations rather
    than broad guidelines
    , the disability assessment board must submit a thorough report to determine if
    the candidate’s impairment would make it difficult for them to complete the MBBS course.
  3. The Court said that the NMC’s rules were excessively general and did not take into account the variety of
    abilities of people with impairments.
    In order to prevent candidates from being unjustly disqualified
    from medical education, it instructed the NMC to update its rules to take a more inclusive stance.
