Rajasthan: UDFA Demands Strict Action as Respect to Dead Bodies Act, 2023, Faces Violations – Call for a Detailed Investigation

The United Doctors Front Association (UDFA) has expressed major concerns about the new breaches of the Rajasthan Respect to Dead Bodies Act, 2023. This Act, which aims to safeguard the dignity and respectful treatment of deceased persons, seems to be poorly enforced, resulting in troubling occurrences that compromise its core objective.

  • On November 8, 2024, Yogesh Sharma (35), a resident of Shastri Nagar, passed away at Jeevanrekha Hospital in Jagatpura, Jaipur. He was admitted for the treatment of stones.
  • The family members of the patient accused the hospital authorities of medical negligence.
  • A large number of lawyers took to the streets. The office bearers of the Bar Association held a meeting with the police officials at the Jaipur Commissionerate demanding action. An agreement was later reached.

The Patient was admitted for the treatment of stones. As the pain increased, the doctors operated on him on November 4. During this time, the operation was interrupted due to an infection in the stomach. On November 7, doctors performed the operation again.

A few hours after the surgery, at approximately 3:30 pm, Yogesh Sharma passed away. On Friday morning, a large group of lawyers gathered at the hospital, demanding action against the doctors and hospital administration. When their demands were not met, they staged a sit-in at the Collectorate. Meanwhile, the family refused to take custody of the body.

Following death of Yogesh, there were blatant violations of the Dead Bodies Act, 2023. Instead of taking action under the Act, the police officials played a complicit role in the alleged illegal recovery of ₹26 lakh by putting pressure on the hospital management by a mob of a few persons to settle the issue by showing it as a negligence. It is possible that the hospital management may not have complained to the Jaipur Police under this Act out of fear, but it is the constitutional obligation of the police to ensure compliance with the laws currently in force in the state.

Violations and Legal Provisions

The Rajasthan Respect to Dead Bodies Act of 2023 forbids utilizing deceased individuals’ bodies for protests or demonstrations. In Section 6 of the Act, any acts of protest that involve the body of a deceased person are prohibited. In contrast, Section 18 outlines strict penalties for these actions, which could include imprisonment ranging from six months to five years. Despite these explicit rules, family members and others involved in this situation used the body of the deceased to carry out protests, damage hospital property, and physically attack staff members.

Media Reports

According to media reports, after the death of the patient, the family members unnecessarily delayed in taking the body of the deceased from the hospital as soon as possible and performing the last rites in a dignified manner. It is an act of disrespect to the dead body which is a serious violation and punishable offence under the Rajasthan Respect to the Dead Body Act, 2023.

Call for Action

  1. UDFA urges Strict action should be taken against them. It should be ensured that all provisions of the Act are strictly followed so that such incidents do not recur in future.
  2. A thorough and impartial investigation There should be a thorough and fair investigation into the incident, including whether the police officers exerted any pressure or provided direct or indirect assistance in causing dishonor to the dead body in disregard of the provisions of this Act.
  3. Concrete steps for effective enforcement of the Act. Necessary steps must be taken to effectively enforce this Act in the State of Rajasthan to ensure healthcare providers’ self-esteem and workplace safety.
  4. Prevention of Illegal Recovery The incident of illegal recovery of Rs 26 lakh from the family of the deceased by the hospital is extremely worrying. Instructions should be issued for strict compliance of this law against cases of intimidation from hospitals across the state.

Ensuring Effective Enforcement

To uphold the dignity of the deceased and protect healthcare providers, concrete steps must be taken to enforce the Act effectively. This includes raising awareness among authorities and the public about the Act’s provisions and ensuring that violations are met with appropriate legal consequences.

The UDFA call for action underscores the need for vigilance and strict enforcement of the Rajasthan Respect to Dead Bodies Act, 2023, to maintain the dignity of the deceased and the integrity of healthcare institutions.
